overseas regulator

  1. (1) (except in relation to the overseas financial stability information power)44 (as defined in section 195(3) of the Act (Exercise of power in support of overseas regulator)) an authority in a country or territory outside the United Kingdom:
    1. (a) which is a Home State regulator; or
    2. (b) which exercises any of the following functions:
      1. (i) a function corresponding to any function of the FSA under the Act;
      2. (ii) a function corresponding to any function exercised by the FSA in its capacity as competent authority in relation to the listing of securities;
      3. (iii) a function corresponding to any function exercised by the Secretary of State under the Companies Acts (as defined in section 2 of the Companies Act 2006);33
      4. (iv) a function in connection with the investigation of conduct of the kind prohibited by Part V of the Criminal Justice Act 1993 (Insider Dealing), or with the enforcement of rules (whether or not having the force of law) relating to such conduct;
      5. (v) a function prescribed by regulations made for the purposes of section 195(4) of the Act (Exercise of powers) which, in the opinion of the Treasury, relates to companies or financial services.4

(2) (in relation to the overseas financial stability information power) (as defined in section 169A(2) of the Act (Support of overseas regulator with respect to financial stability)) an authority in a country or territory outside the United Kingdom which exercises functions with respect to the stability of the relevant financial system operating in that country or territory.44
