overseas person

(in accordance with article 3(1) of the Regulated Activities Order (Interpretation)) a person who:

1. (a) carries on any of the following regulated activities:
   1. (i) dealing in investments as principal;
   1. (ii) dealing in investments as agent;
   1. (iii) arranging (bringing about) deals in investments;
   1. (iv) arranging (bringing about) regulated mortgage contracts;911
   1. (v) making arrangements with a view to regulated mortgage contracts;911
   1. (vi) making arrangements with a view to transactions in investments11;
   1. (vii) managing investments11;
   1. (viii) safe custody and administering investments; 11
   1. (ix) sending dematerialised instructions11;
   1. (x) causing dematerialised instructions to be sent11;
   1. (xi) establishing, operating or winding up a collective investment scheme11;
   1. (xii) acting as trustee of an authorised unit trust scheme11;
   1. (xiii) acting as the depositary or sole director of an open-ended investment company11;
   1. (xiv) establishing, operating or winding up a stakeholder pension scheme11;
   1. (xiva) establishing, operating or winding up a personal pension scheme;24
   1. (xv) advising on investments11;
   1. (xvi) advising on regulated mortgage contracts 9 11;
   1. (xvii) entering into a regulated mortgage contract ;9 11
   1. (xviii) administering a regulated mortgage contract 9 11;
   1. 26(xix) arranging (bringing about) a home reversion plan;
   1. 26(xx) making arrangements with a view to a home reversion plan;
   1. 26(xxi) advising on a home reversion plan;
   1. 26(xxii) entering into a home reversion plan;
   1. 26(xxiii) administering a home reversion plan;
   1. 26(xxiv) arranging (bringing about) a home purchase plan;
   1. 26(xxv) making arrangements with a view to a home purchase plan;
   1. 26(xxvi) advising on a home purchase plan;
   1. 26(xxvii) entering into a home purchase plan;
   1. 26(xxviii) administering a home purchase plan;
   1. (26xxix26) agreeing to carry on those regulated activities 11, disregarding the exclusion in article 72 of the Regulated Activities Order (Overseas persons); but9 11
1. (b) does not carry on any such activities, or offer to do so, from a permanent place of business maintained by him in the United Kingdom.4
