overseas long-term insurer

an insurance undertaking which is not an authorised person and which:

1. (a) has its head office in an EEA State other than the United Kingdom, and is entitled to carry on long-term insurance business in that EEA State; or
1. (b) has a branch or agency in an EEA State other than the United Kingdom and is entitled to carry on long-term insurance business in that EEA State; or
1. (c) is authorised to effect or carry on long-term insurance business in the Bailiwick of Jersey, the Bailiwick of Guernsey, the Isle of Man, the Commonwealth of Pennsylvania or the State of Iowa;

for the purposes of (a) and (b), Gibraltar is to be regarded as if it were an EEA State. 4
