an investment firm that has its registered office (or, if it has no registered office, its head office) in an EEA State:68

(a) excluding a person to whom the ISD does not apply under article 2(2) of the ISD; but68

(b) including a BCD credit institution whose Home State authorisation includes a core investment service.5 68
