EEA banking and investment group

21a banking and investment group that satisfies one or more of the following conditions:

1. (a) it is headed by:
   1. (i) an investment firm or credit institution that is authorised and incorporated in an EEA State; or
   1. (ii) a financial holding company that has its head office in an EEA State; or
1. (b) it has as a member an investment firm or credit institution that:
   1. (i) is authorised and incorporated in an EEA State; and
   1. (ii) is linked with another member that is in the banking sector or the investment services sector by a consolidation Article 12(1) relationship; or
1. (c) it is otherwise required by EEA prudential sectoral legislation for the banking sector or the investment services sector (except Article34 14334 of the Banking Consolidation Directive (Third-country parent undertakings)) to be subject to consolidated supervision by a competent authority.
