banking and investment group

13a group of persons (at least one of which is an EEA regulated entity that is a credit institution or an investment firm) who:

1. (a) form a group in respect of which the consolidated capital adequacy requirements for the banking sector or the investment services sector under:
   1. (i) the87 appropriate regulator's 87 sectoral rules; or
   1. (ii) the sectoral rules of another competent authority; apply; or
1. (b) would form such a group if the scope of those sectoral rules were amended as described in paragraph 3.1 of GENPRU 3 Annex 2 23 (removing restrictions relating to place of incorporation or head office of members of those financial sectors).
